Terms of service
Vager Marketing Terms of Service.
These Terms govern your use of Vager Marketing. They explain the current product, what you receive, what remains your responsibility, and how subscriptions work.
Last updated: September 19, 2026
1. Who these Terms are with
These Terms are an agreement between you and Vager Media, the operator of Vager Marketing ("Vager Marketing," "we," "us," or "our"). By creating an account, starting a build, or using the service, you agree to these Terms and our Privacy Notice. You must be at least 18 and able to enter a binding contract.
2. What Vager Marketing provides
Vager Marketing is an AI marketing workspace for your business. It supports business research, strategy, website and creative production, email outreach, supported advertising and social accounts, leads, and reporting. You direct the work and choose which connected accounts and actions to authorize. Work that does not pass its required checks may pause or fail.
Features labeled "planned," "preview," or similar are not part of your purchase until they are made available. We may improve or change the service, but we will not retroactively charge you for a feature you did not buy.
3. Trial, subscription, and cancellation
- Your selected plan, recurring price, any setup charge, included capacity, and taxes are shown before you confirm checkout.
- Free research or an account signup does not itself authorize a charge. Paid production requires an active eligible subscription.
- Stripe charges the amount you confirm at checkout and renews the subscription at the displayed interval until cancellation.
- Paid accounts can cancel through the Stripe billing portal linked from the dashboard. Cancellation takes effect at the end of the paid billing period unless law requires otherwise.
- Advertising spend and charges from services you connect are separate from your Vager Marketing subscription.
Fees already paid are non-refundable except where required by law or where we decide a billing error or service failure warrants a refund. Email benjamin@vagermedia.com if you believe a charge is wrong. The checkout page controls if it displays a different price, billing interval, promotion, or tax amount before purchase.
Vager Marketing points
Paid plans include a monthly Vager Marketing point allowance shown in the product or at checkout. Vager Marketing points measure useful completed work; not underlying provider usage or time spent. Monthly allowances do not roll over unless Vager Marketing expressly says otherwise.
Applicable points are reserved before paid work, used after verified success, and refunded when the recorded outcome qualifies for a refund. Your dashboard shows the allowance used and remaining.
When no unreserved points remain, new work that requires points pauses. Work that was already fully reserved may finish, and your dashboard and work history remain available. Any option to add points will appear only when it is available for your account.
4. Your account and instructions
Keep access to your email account secure and give us accurate information. You are responsible for activity under your account and for the business instructions, facts, claims, contact details, and other material you submit. Tell us promptly if you believe your account has been compromised.
4a. Connected accounts and standing permission
You may approve individual actions or grant standing permission within the accounts, recipients, destinations, action limits, and budgets you choose. Actions outside those limits require further approval. Standing permission can include publishing, sending email, and activating advertising without reviewing each action separately. Some work still requires exact review when its behavior cannot be verified against your limits.
You can pause or revoke standing permission. Revocation prevents new dispatches but cannot recall an email, erase a published post, or undo an external action already accepted by a provider. Use the campaign pause controls to stop active advertising. Provider confirmations can be delayed; committed advertising budgets remain counted until they are reconciled. A platform budget limit does not replace the budget controls in your connected advertising account.
5. Your content and generated deliverables
You keep your rights in material you submit. You give us a worldwide, non-exclusive license to host, copy, process, modify, and transmit that material only as reasonably needed to provide, secure, support, and improve your use of Vager Marketing.
As between you and Vager Marketing, we assign to you any rights we may have in the websites, copy, research, and other marketing deliverables generated specifically for you, subject to payment of amounts then due, if any. That assignment does not include our platform, templates, general techniques, tools, or other pre-existing material. It also cannot create rights that the law does not recognize or override the rights and terms of third-party services or material.
6. AI output and your review
AI-generated output can be incomplete, inaccurate, non-unique, or unsuitable for your situation. Our build evidence verifies specified technical events and checks; it does not prove that every statement is legally, factually, or commercially correct. You remain responsible for supplied facts, content rights, regulatory obligations, and the business decisions and standing permissions you authorize. You can require review of each external action; otherwise, eligible actions may run within your standing limits without individual review. Vager Marketing does not provide legal, tax, financial, medical, or investment advice.
7. Leads and your customers
Leads submitted through your generated site are collected for you and delivered to your dashboard. You determine why and how you contact those people. You are responsible for your own privacy notice, marketing consent, communications, recordkeeping, and compliance with laws that apply to your business. Do not use Vager Marketing to send deceptive, unlawful, or unsolicited communications.
8. Acceptable use
You may not use Vager Marketing to:
- break the law, violate another person's rights, or create deceptive claims;
- submit content you do not have permission to use;
- distribute malware, probe or bypass security, scrape the service abusively, or interfere with other users;
- impersonate another person, exploit children, or promote violence or illegal goods or services; or
- resell or reverse engineer the service except where applicable law expressly permits it.
We may remove content or suspend access when reasonably necessary to protect users, third parties, or the service.
9. No earnings promise
Vager Marketing builds and verifies execution; it does not guarantee customers, revenue, profit, funding, or business success. Results depend on your market, offer, effort, decisions, and circumstances outside our control. Do not interpret an example, generated forecast, testimonial, or build receipt as an earnings claim.
10. Third-party services
Vager Marketing relies on third-party infrastructure, AI, research, email, payment, and deployment providers. Their services and terms may affect availability and output. Stripe, not Vager Marketing, processes your full payment-card details. We are not responsible for third-party products you choose to connect or for external sites linked from the service.
11. Suspension and termination
You may stop using Vager Marketing at any time and may cancel a paid subscription as described above. We may suspend or terminate access for material breach, nonpayment, security risk, unlawful use, or harm to the service or others. Where practical, we will give notice and a chance to cure. Data handling after closure is described in the Privacy Notice.
12. Disclaimers
To the fullest extent permitted by law, Vager Marketing is provided "as is" and "as available." We disclaim implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant uninterrupted service or that output will be accurate, unique, lawful, or effective. Some jurisdictions do not allow certain disclaimers, so they may not all apply to you.
13. Limitation of liability
To the fullest extent permitted by law, neither Vager Marketing nor its suppliers will be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, goodwill, data, or business opportunity. Our total liability arising from the service will not exceed the greater of $100 or the amount you paid Vager Marketing during the 12 months before the event giving rise to the claim. These limits do not apply where applicable law does not permit them.
14. Responsibility for misuse
You will defend and indemnify Vager Marketing from third-party claims arising from your unlawful use of the service, your submitted content, your customer communications, or your violation of another person's rights. This does not require you to cover claims caused by Vager Marketing's own unlawful conduct.
15. Governing law and disputes
Before filing a formal claim, contact us and give us 30 days to try to resolve it. These Terms are governed by Texas law, without regard to conflict-of-law rules, except where the consumer-protection law of your home jurisdiction must apply. Claims may be brought in a court with jurisdiction in Texas. Nothing here limits rights you cannot waive under applicable law.
16. Changes and contact
We may update these Terms as the service or law changes. We will post the updated date and give additional notice when a change materially affects existing users. Continued use after the effective date means you accept the updated Terms.
